The Community Organization FitSpirit ("Fillactive" or "we" or "our" or "us") provides you with this privacy policy ("Privacy Policy") to inform you ("User" or "Users" or "you") of our policies and procedures regarding the collection, use, retention, and disclosure of personal data and information that we receive from Users who use the Fillactive website (the "Site") and its services (the "Services"). This Privacy Policy applies to anyone using the Site and the Services 

We are committed to providing safe Sites for Users of all ages and have implemented this Privacy Policy to demonstrate our firm commitment to your personal information. Fillactive complies with federal and Quebec laws and regulations on the protection of personal information, including the Personal Information Protection and Electronic Documents Act (S.C. 2000, c. 5) and the Act Respecting the Protection of Personal Information in the Private Sector, CQLR, c. P-39.1. 

ACCEPTANCE OF OUR PRIVACY POLICY

Your use of our Sites or interactive advertising banners signifies your acknowledgment, acceptance, and consent to our Privacy Policy, and you adhere to the terms and conditions posted on the Site. If you do not accept this Privacy Policy, please do not continue to use our Sites. Your use of the sites signifies your acceptance of these terms and any changes in effect at the time of use. By submitting your information, you agree that it will be governed by our Privacy Policy. 

COLLECTION OF PERSONAL INFORMATION

In this Privacy Policy, the term "Personal Information" refers to any information about you that can identify you as an individual. For example, you may provide your name, first name, postal address, date of birth, email address, phone number, cell phone number, or banking or financial information, among other things. We collect information that you provide to us, for example when you:

  • Submit a comment or question via our Site through any means of communication or on our social media accounts;
  • Make a donation to Fillactive;
  • Fill out a form on our site;
  • Consent to receive marketing communications via any means of communication;
  • Respond to a survey, poll, or participate in a contest on our Site or our social media accounts;
  • Provide us with any document containing Personal Information;
  • Apply for or hold a position at Fillactive;
  • Communicate with us.

 

We also collect your Personal Information when we offer you health assessment tools that require you to provide self-assessment information. We may also ask you to provide additional information, such as your email address, if you wish to obtain additional services, information, participate in a contest, or address complaints or concerns. 

When you provide us with Personal Information from a third party, you represent and warrant that you have obtained the third party's consent to the disclosure of their Personal Information to Fillactive and have informed them of this disclosure. 

HOW DOES FILLACTIVE USE THE INFORMATION COLLECTED ABOUT USERS? 

Before submitting Personal Information to us, please note that all information collected on our Sites may be used as follows: 

  • For research, development, and statistics related to our Sites and/or for the future development of the Site and understanding User experience; 
  • To monitor interest and improve our Services; 
  • To help us tailor the content of our Sites, improve the User experience, and understand your needs; 

  • To create a profile about you in order to show you content that may interest you and display content according to your preferences;

If a User objects to such use for any reason, they can prevent such use by email request or by modifying the provided registration information. Fillactive makes reasonable efforts to keep User information in a secure environment. DISCLOSURE OF INFORMATION

Fillactive will not disclose the Personal Information you provide on its Sites to third parties other than a Fillactive agent, except:

  2. to comply with legal requirements such as a law, regulation, warrant, subpoena, or court order, and/or 
  3. if you report an adverse event/side effect, in which case Fillactive may be required to disclose such information to regulatory authorities, including but not limited to Canadian and/or international regulatory authorities; or
  4. to our service providers who are held to the same level of protection of Personal Information as we are;

By consenting to this Privacy Policy, you consent to the transfer and storage of your Personal Information in any province of Canada.

Fillactive, like many website operators, may use a standard technology called "cookies" on its Sites. You can disable cookies by disabling them in your browser; however, some areas of the Sites may not function properly if you do so. 

CHILDREN'S CYBERSECURITY

Fillactive considers the protection of children's personal information, particularly online, to be of the utmost importance. We do not knowingly collect or solicit personal information from children, nor do we allow them to become registered Users or request information through our Sites or helplines.

We are not responsible for the privacy practices of other sites you may visit when using our Services or when browsing our Site, and we encourage you to read their privacy policies. 

The following additional information applies to our Sites that require registration. In general, you are not required to provide Personal Information as a condition of using our Sites, except to the extent necessary to provide the Service you have requested. However, some of our Sites are reserved for specific individuals, and we may require these individuals to register upon entry by providing certain information.

INFORMATION SECURITY

We have implemented physical, electronic, and managerial procedures to protect and prevent unauthorized access, maintain data security, and properly use the information we collect online. Fillactive applies appropriate security measures to the sensitivity of the information, such as keeping information in secure facilities and making Personal Information available only to authorized employees who need to know in order to fulfill the purposes for which Personal Information is collected or to comply with any legal or regulatory obligations. 

STORAGE OF INFORMATION AND INTERNATIONAL TRANSFER 

The Personal Information you share with us is stored on our database servers in Fillactive's data centers, whose servers are located in Quebec. By consenting to this Privacy Policy, you consent to the storage of your Personal Information. 

Additionally, pursuant to agreements between Fillactive and external service providers, your Personal Information may also be hosted and/or transferred to and stored on other servers located outside your jurisdiction, where data protection laws may not guarantee similar or adequate protection as that of your jurisdiction. By consenting to this Privacy Policy, you consent to such transfer, hosting, and storage of your Personal Information. 

We will retain Personal Information for the duration necessary to achieve the purposes for which we collect it or to comply with any legal or regulatory obligations. Once this period has expired, we will proceed with the destruction or anonymization of your Personal Information in accordance with Fillactive's policies and applicable laws. 

RIGHT TO REVIEW INFORMATION 

In accordance with applicable privacy laws, you have the following rights regarding your Personal Information: 

  • Right of Access: You can inquire whether we hold Personal Information about you and, if so, request a copy of it. Fees may be charged for transcription, reproduction, or transmission of this information. 
  • Right of Rectification: If Personal Information about you is inaccurate, incomplete, or equivocal, or if its collection, communication, or retention is not in accordance with or authorized by the Private Sector Personal Information Protection Act, CQLR, c. P-39.1 (the "Act"), you may request rectification.

WITHDRAWAL OF CONSENT 

You may at any time decide not to consent to the retention of your Personal Information by sending a written request to [email protected]. Upon receipt of notice of revocation of your consent, we will stop retaining your Personal Information within a reasonable time, which will vary depending on the Personal Information we have collected and the purpose for which we have collected it. 

Please note that we will send you a confirmation email upon receipt of your request. Please note that if you choose to withdraw your consent, your experience of using the Services and browsing our Site may no longer be optimal, and you may no longer have access to all our Services and our entire Site.
